Statement from the Westwood Select Board in regard to the May 18, 2026 Judgment pertaining to Town of Westwood v. the Westwood Land Trust
The Select Board sought clarification from the Court over which types of agricultural uses were permitted under the conservation restriction. On May 18, 2026, the Court issued its decision that while the conservation restriction does not allow the prohibition of all agricultural uses, the Town’s originally contemplated proposal would not be allowable. The Town respects the Court’s decision and intends to honor it.
The Board has heard from residents who hold sincere concerns about this matter, and while many hold differing opinions on the case, a common thread that nearly all carried was a sincere desire to see this matter resolved so Westwood can move forward as one community. The Select Board agrees.
The Board has decided that it will not appeal the Judge’s decision, or seek further litigation of this, while reserving the right to defend itself against new claims brought against the Town. It invites the Westwood Land Trust to similarly commit to ceasing further litigation involving this matter and hopes to renew its partnership in protecting the incredible resources of Westwood.
